Terms and conditions

1. General Information

These Terms and Conditions apply to all services provided by Kipinäjänis. Kipinäjänis services are owned and operated by Kipinäjänis (business ID 3432376-4).

These terms and conditions are valid from 14.5.2024. Kipinäjänis may change the terms of service unilaterally from time to time, so please check the terms of service each time before you purchase my services.

2. Description of content of services

Kipinäjänis offers a wide range of services, more detailed descriptions and contents of which can be found on our website kipinajanis.fi. These services may include coaching, courses and other activities related to creativity and social media.

3. Registration and cancellations

Registration: Signing up for services and courses happens in advance via the website, by e-mail or other agreed means. Registration is binding.

Group bookings are made by e-mail or via the form on the website and are binding once the customer has accepted in writing the offer sent by Kipinäjänis.

Cancellations: Cancellations of ordered services or course participation must be made at least 5 days before the start of the service unless otherwise agreed. If the customer fails to arrive at the course without giving notice of cancellation, booking fee will not be refunded.

The service provider reserves the right to cancel the service if there are not enough participants. Customers will be informed of this in good time and any fees paid will be refunded.

If the service cannot be delivered for reasons attributable to Kipinäjänänis, the booking fee and any other fees already paid will be refunded.

If a group booking is cancelled by the customer within less than one week (7 days) of the date of the event, Kipinäjänis reserves the right to charge 20% of the service price as compensation for the time and effort spent on planning, or if a booking fee has been paid in advance, it will not be refunded in the event of cancellation.

Cancellations due to weather: if Kipinäjänis considers the weather to be such that it is not reasonable or safe to hold the event, the booking fee and any other payments already made will be refunded or an alternative date will be found for the event.

If Kipinäjänis considers that the prevailing weather conditions do not prevent the event from being organised, but the client wishes to cancel the event, the normal cancellation conditions will apply, in which case Kipinäjänis reserves the right to charge 20% of the service price as compensation for the time and effort spent on planning, or if a booking fee has been paid in advance for the service, this will not be refunded in the event of cancellation.

4. Prices and terms of payment

Prices: The prices of the services are determined by the current price list and include VAT unless otherwise stated. The current prices are available on the website www.kipinajanis.fi and, in the case of group bookings, are specified in the quotation sent to the customer by e-mail before the order is confirmed.

Terms of payment: When you order a service or register for a course by filling in a form on the website or by sending an e-mail, you will receive payment instructions in reply, which you can follow to pay for your order.

As a general rule, the accepted payment methods are MobilePay, invoice and bank transfer. Information on the payment methods is available on the website for each service.

For some services, a booking fee will be charged before the service is provided. This is mentioned separately in the description of the service.

For group bookings, the payment conditions are set out in a written offer sent to the customer before the binding reservation is made.

The right to change prices and any delivery charges is reserved.

5. Delivery and travel expenses

Delivery costs: Generally, Kipinäjänis will deliver services for which there are no delivery costs.

For individual product orders (watercolours, other possible products), the Post Office’s or Matkahuolto’s price list applies, depending on the weight and dimensions of the shipment. Please note shipping is only available within Finland (excl. Åland).

Travel expenses: When a customer orders services for his/her own group more than 15 km from Kipinäjänis’ place of residence (Susisalontie 5, 80710 Lehmo), I charge travel expenses of 0,57e/km. I will include any travel costs in the written offer and you can always check them before accepting the offer.

6. Terms and time of delivery for services

Delivery time: Delivery of services will be subject to specific delivery schedules and will be announced separately. If the service is subject to a weather reservation, an attempt will be made to provide an alternative date for the service.

Method of delivery: The services will be provided at the agreed location or remotely. For details of delivery methods, see the descriptions of the services at kipinajanis.fi.

7. Liability and insurance

Limitation of liability: The provider is not responsible for the personal belongings or health of the participants. It is the responsibility of the client to take out their own insurance to cover any accidents, injuries or illnesses that may occur during the services.

Insurance: The service provider has liability insurance to cover any damage directly caused by the services.

8. Termination of contract

The contract may be terminated by either party in the event of force majeure without penalty. Force majeure is defined as natural disasters, epidemics, acts of war, government restrictions and problems with telecommunications.

9. Complaints and customer support

Complaints: Any complaints must be made in writing within 14 days of the service being provided. Complaints will be dealt with as soon as possible and the customer will be informed of the action taken.

10. Applicable law

These terms and conditions are governed by Finnish law. Any disputes that may arise shall be settled primarily by negotiation. If no agreement can be reached, the matter may be referred to the Consumer Disputes Board or the District Court.

Effectiveness: The customer is responsible for achieving the objectives and desired results that they have set for themselves.

Mental health: These services are not, and are not a substitute for, therapy or other treatment and rehabilitation for mental illness. The client is obliged to disclose any mental health diagnosis that requires professional help prior to committing to coaching services provided by Kipinäjänis. The provider reserves the right to terminate the coaching relationship if the client’s situation is such that it is not in the client’s best interest to continue coaching. In this case, the client will only pay for the services already provided and any prepaid services will be refunded.

Confidentiality: Coaching services are subject to confidentiality.
